COOKIES POLICY

Cookies are small text files containing a certain amount of information exchanged between a website and the user’s terminal (usually the browser). They are primarily used for the purpose of operating the websites and making them operate more efficiently, as well as for the purpose of providing information to the owners of the site itself. Cookies can be either session or persistent. Session cookies remain stored in the terminal for a short period of time and are deleted as soon as the user closes the browser. Their use is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to allow a safe and efficient exploration of the site. Persistent cookies, on the other hand, remain stored in the user’s terminal until a set deadline. These, not being deleted directly when the browser is closed, allow the website operator to remember the choices made by the user on that site as well as to collect information about the pages of the site visited by the user, the frequency with which the site is visited and to identify the navigation path of users, in order to improve the experience on this site. Session or persistent cookies may be First Party or Third Party cookies, depending on whether the person who installs the cookies on the user’s terminal is the same operator of the site that the user is visiting (we will then talk about First Party cookies) or a different person (we will then talk about Third Party cookies).

Types of cookies

  • Technical cookies. Technical cookies are those used for the sole purpose of “transmitting a communication over an electronic communication network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such a service” (see art. 122, paragraph 1, of the Code). They can be divided into navigation or session cookies, which guarantee normal navigation and use of the website; analytics cookies, assimilated to technical cookies when used directly by the website operator to collect information, in aggregate form, on the number of users and on how they visit the website itself; functionality cookies, which allow the user to navigate according to a series of selected criteria in order to improve the service provided to the same. The installation of such cookies does not require the prior consent of the users, while the obligation to provide information pursuant to art. 13 of the Code, which the operator of the site, if using only such devices, may provide in the manner he deems most appropriate.
  • Profiling cookies. Profile cookies are designed to create user profiles and are used to send advertising messages in line with the preferences expressed by the user when surfing the web. Because of the particular invasiveness that such devices may have in the private sphere of users, the European and Italian legislation requires that the user must be adequately informed about their use and thus express their valid consent. Article 122 of the Code refers to them where it provides that “the storage of information in the terminal equipment of a contractor or a user or access to information already stored is permitted only on condition that the contractor or user has given his/her consent after being informed in the simplified manner referred to in Article 13, paragraph 3” (Article 122, paragraph 1, of the Code).
